Photography Service Contract


WEDDING PHOTOGRAPHY SERVICE CONTRACT

SERRA RIBEIRO PHOTOGRAPHY


This contract concerns the provision of wedding photography services for (NAMES), hereinafter referred to as the "client," to take place on (DATE). The photographer, Rui de Vasconcelos Serra Ribeiro, representing the company Serra Ribeiro photography, will be referred to as the "contractor."


1 – Image Capture

a) The Photographer shall capture the most relevant and meaningful moments at the designated locations, with the purpose of producing a collection of photographs that document and illustrate the event with quality and professionalism.


2 – Service Details

Detailed description of service, locations, and schedule.


3 – Delivery of Work

a) Selected photographs will be individually edited.

b) Delivery in digital format: high resolution for printing (via app) and web version in an online gallery (password-protected), within 60 days after the wedding date.

c) The Clients must download the complete work in high resolution within the indicated timeframe.

d) The online gallery will remain active for 60 days. Clients may mark photos as private, download, share the access link with guests, select favorites, comment, and order prints or albums through the gallery.

e) The Photographer will maintain a backup copy in internal archive for 2 years.

f) Unedited photographs and RAW files will not be provided, in order to ensure full control of the editing process and to preserve the Photographer’s visual identity.


4 – Responsibilities

a) The Clients shall provide all necessary information, schedules, locations, and authorizations (if applicable) to ensure proper performance of the service.

b) The Clients shall provide the Photographer and assistant with a meal equivalent to that of the guests, at no additional cost, at the staff table, and served at the same time as the guests’ meal, ensuring uninterrupted coverage of important moments.

c) In the event of force majeure (including but not limited to serious illness, accident, or death) that prevents the wedding or the provision of the photography services, the affected party shall provide official documentation to prove the situation (e.g., medical certificate, death certificate, or other legally recognized document).

In such cases:

If the impossibility is on the part of the Clients, the Photographer shall refund in full the deposit paid within 15 (fifteen) business days.

If the impossibility is on the part of the Photographer, the Photographer shall refund in full the amounts paid by the Clients within 15 (fifteen) business days and will make reasonable efforts to propose a substitute photographer of equivalent experience. The Clients may accept or refuse the substitution. In case of refusal, the refund shall be full and final, and no further compensation shall be due.


5 – Additional Services

a) Up to 30 days before the event, the Clients may add services to the original agreement.


6 – Payment and Validation of Agreement

a) This agreement shall be considered fully valid and accepted upon transfer of the deposit of €250 (two hundred and fifty euros) to the Photographer’s bank account, within 7 (seven) business days of receipt of this document.

b) The event date will only be secured once payment has been confirmed.

c) Payment of the deposit implies full acceptance of the terms herein, and no signature of the Clients is required.

d) After the planning meeting, the remaining balance must be paid up to one week before the event date. Failure to pay in full within this period will make it impossible to provide the service, and the deposit will not be refunded.


7 – Copyright and Use of Images

a) All copyright of the photographs remains the exclusive property of the Photographer, in accordance with applicable copyright law.

b) The Clients are granted a personal, private, lifetime license to use the delivered photographs, without the right to sublicense, transfer, or exploit them commercially without prior written authorization from the Photographer.

c) Alteration, modification, or application of filters to the delivered photographs without the Photographer’s consent is strictly prohibited.

d) The Photographer may use some photographs from the event for portfolio, website, social media, and promotional purposes, unless the Clients expressly object in writing prior to the wedding date. Under no circumstances will images that may negatively or embarrassingly expose the Clients or their guests be used.


8 – Jurisdiction

Any dispute arising from the interpretation or performance of this agreement shall fall under the jurisdiction of the District Court of Faro, with express waiver of any other forum.
